Nursery with no Deputy?

I have herd of a nursery that is planning on not having a deputy manager. they know about the named deputy bit in the EYFS but say that as long as the person knows they are in charge when the manager is not there that covers it. Anybody else heard of this? Views and opinons please!

It sounds to me like they're trying to save money ie they WILL have a deputy (someone who is nominated to be in charge in the manager's absence) but they are not willing to give that person the title and therefore the pay they deserve. I hope no-one agrees to fulfill that role!

thanks for that, glad it's not just me! it gets worse though as they have a manager and a deputy, both can apply for managers job - looser will b made redundant.
not sure it's legal.....
I have a manager in my new preschool but currently no deputy. I have two candidates but need to see how they cope with a new setting and work with the manager before apppointing one.

Hi Kaz, That makes sense! this nursery however has a manager and a deputy but plans to only have a manager soon. no deputy at all

Why would you apply for a job that if you don't get it results in you being made redundant?

if they dont apply one will still be made redundant.

This is not legal you're right - I would get your current manager to get some help from an employment law helpline or something like ACAS. I dont know all the details but if there's already a manager in place unless they sack her they cant get rid of her and certainly cant make her apply for her own job along side the deputy. If you are to ake some one redundant you are making their post redundant therefore saying they no longer need that post - so if they were to make the manaer redundant they are saying they dont need a manager and can not legally employ a manager for a 6 months!! and without a manager they cant run so definately get your manager to get some advice I have been through TUPE law when taking over nurseries and this is definately not legal - hope this helps.

I think it can be done and classed under reorganisation but I think when this is done they have to it with all staff.best people to speak to are ACAS they are independent and offer free advice just google them.

I'm pretty sure its not enough just to know who would be in charge if the manager is not there, recently read an ofsted inspection where its noted that the nursery hadn't met the requirements of the compulsory part of the Childcare Register as they didn't have a named deputy
Yes you do have to have a named deputy. All roles need to be named on your policies.
I had to make some staff redundant a couple of years ago (long story!) so could not re-employ in that role for 3 months.

It is possible to have more than one named deputy - a really useful solution where opening hours are long. I makes it much easier to ensure that a named deputy is on the premises at all times.
