Do your lunch breaks count as part of your working hours?  Eg. If I work an 8-6 shift and have an hour for lunch is this 9 hours worked or 10?

I did work at one place where they needed the staff to stay on site in case of emergency evacuations. I dare say they've stopped that now due to the way the minimum wage would be calculated.

Depends on how your paid (i.e by the hour or annual salary) and what your contract states e.g. contracted for ... hours with .... break. With a salary I suppose it depends on how you would interpret your hourly rate 

To add to what Tiggy has said it also depends on your role as to whether you may need to remain on site such as deputy requiring to be there if the head/manager isn't on site.

I have heard of places where they will ask staff to remain in the setting in case of a fire alarm but tbh most place I know ensure that they have enough staff covering breaks so that its not necessary for those on breaks to stay

Check your contract. If you are paid for your break then you will have to stay on site and therefore they will count as part of your working hours.

If you are not paid and are free to leave the setting then this willnot count as your working hours.

I pay my staff for lunch as they work a rota so that some have lunch with the children while the rest go to the staff room.

In my old place we worked 6.5 hours without a lunch break which is illegal.

 

We sat with the children and ate lunch but we were still working and not allowed out the building.
